  • Priority Question on on rent reduction for tenants in Fishery Harbour Centres – text – Thomas Pringle TD
    has in the region of 140 property agreements in place in the six Fishery Harbour Centres Property agreements are complex instruments and the specific terms of those agreements held with my Department vary Of the total in place approximately 80 property agreements do not contain rent review clauses which require rent to be static or increased in the subsequent period These include short term licence agreements and pending lease agreements Any property agreements entered into subsequent to the application of Section 132 of the Land and Conveyancing Law Reform Act 2009 contain rent review clauses in which the rent payable following the review may be fixed at an amount which is less than greater than or the same as the amount of rent payable immediately prior to the date on which the rent falls to be reviewed In the region of 60 lease agreements contain rent review clauses which require static or increased rent to be applied for the subsequent period All 60 of the property agreements that contain such rent review clauses were signed prior to the application of Section 132 of the Land and Conveyancing Law Reform Act 2009 These agreements generally require rent reviews to be conducted every five years The most recent round of rent reviews on these agreements related to the period up to mid 2008 A number of the rental valuations determined by the qualified valuer appointed by the Department following a tender competition were disputed by the tenants The rent review dispute procedures set out in the tenants leases were followed and in some cases the independent experts recommended a decrease in the revised valuation determined by the valuer acting on behalf of the Department I am acutely aware of the economic situation facing businesses and small enterprises and following the completion of

    its contribution to our economy Despite the severe effects across the economy of the current economic downturn the processing sector has fared very well in terms of maintaining employment Indeed many progressive businesses in the processing sector have bucked the general trend in the economy and have been on a sustained growth and expansion path CSO figures show that seafood exports were valued at 495 million in 2012 an increase of 18 over 2011 I am advised by Bord Iascaigh Mhara that some 2 870 people are presently employed in the seafood processing sector Arising specifically from an investment of 12 8 million by 18 seafood processing companies in 2012 with 2 6 million in financial assistance under the Seafood Processing Business Investment Scheme 296 additional jobs and increased sales of value added seafood products of nearly 105 million are expected to be created by 2015 That is a significant level of investment by any standards and together with previous investment of 7 million by 21 companies in 2011 and 2 7 by 8 companies in 2010 with the support of the Seafood Processing Business Investment Scheme is setting a clear path to achievement of the potential of the seafood sector to create sustainable employment in peripheral coastal communities I have recognised the success of the Scheme by increasing its capital budget from 1 5 million in previous years to 2 5 million in 2013 The processing sector has a number challenges that it must rise to in order to achieve its high growth potential The Seafood Processing Business Investment Scheme seeks to assist the sector in meeting those challenges Overall the Scheme seeks to support the sector in becoming more cost competitive and more attuned to market needs It seeks to address structural deficits by encouraging a restructuring of the processing sector to achieve appropriate scale and operational efficiency to compete in competitive international markets It encourages partnerships enhanced cooperation and sharing of distribution channels by operators to strengthen their abilities to win and maintain contracts with major European and Asian buyers such as retail multiples It seeks to support the sector in modernising so that it meets the quality requirements standards and certification demanded by international markets Last but not least the Seafood Processing Business Investment Scheme seeks to encourage the sector to make the most of the raw material that is our fish landings and aquaculture output This means moving away from exporting commodity products and instead focussing on adding the maximum value to our fish The Scheme seeks to assist with these objectives In helping the processing sector to grow in this way we will see turnover and employment grow and contribute to the growth and recovery of our economy To further assist the processing sector achieve its high growth potential I am proposing to further incentivise the sector to focus its future on the value added sector by offering a higher grant rate to value added processing projects I propose to increase the maximum grant

governing the approval of attendance at seminars conferences by staff of my Department These include that the topic of the event must be directly relevant to the officer s official duties and the numbers attending must be kept to a minimum Prior approval of attendance must be given by the officer s Principal Officer or higher and by the Department s Learning Development Unit In relation to   • Oral Question on a differential rates system for retailers – Thomas Pringle TD
    REPLY Minister for the Environment Community and Local Government Mr P Hogan I propose to take Question Nos 134 and 165 together I have no immediate plans to amend the legislation governing commercial rates Local authorities are under a statutory obligation to levy rates on any property used for commercial purposes in accordance with the details entered in the valuation lists prepared by the independent Commissioner of Valuation under the Valuation Act 2001 The Commissioner for Valuation has sole responsibility for all valuation matters including the most appropriate method of valuation The levying and collection of rates are matters for each individual local authority It is important to acknowledge that commercial rates as a local tax and the rating system generally are deeply embedded in the local government system A large body of case law is well established and local authorities and ratepayers are in the main very familiar with and generally accepting of the operation and practice of the rating system Rates are also a stable source of financing for local government which is not affected unduly by short term changes in economic circumstances A property based tax such as rates has a distinct advantage over any tax based on profits or incomes as it is generally found to be easy to collect and difficult to evade A system having regard to economic factors on an ongoing basis would create uncertainty by providing for continuous change to the valuation base Such a system would not provide a stable basis for funding local government and would require significant additional resources to operate I am conscious that local authorities have exercised restraint in setting their Annual Rates on Valuation in recent years and the average change of ARV across the 88 local authorities has shown a decrease in each of the
