    Agency RIA In quarter 3 2008 the applicant found the DP accommodation unsuitable in her family circumstances and went to live with friends in Dublin and applied for SWA at the standard rate When the applicant applied for SWA the scheme was administered by the Community Welfare Service CWS division of the HSE on behalf of the Minister for Social Protection The initial decision by the CWO on SWA for a third country national did not take into account the Habitual Residence Condition i e the applicant was refused SWA on the grounds of leaving DP which has no legislative basis The SWAO allowed the appeal as the reason for SWA being refused as left DP had no legislative basis This DSP had no role in deciding entitlement in this case The CWS transferred to the DSP with effect from 1 January 2011 to end of September 2011 on a secondment basis and from 1October 2011 the staff of the CWS transferred to the Department as civil servants On reviewing the case DSP accepts that there was an unnecessary and unwarranted delayed payment of arrears by HSE to the applicant in this case as the Officer dealing with the appeal did not ensure the SWAO decision was followed up in full Implementing Appeals Decisions Following the transfer of the CWS into this Department designated person and appeals training was commenced for former CWS staff through the Department s Staff Development Unit The course is to ensure staff ü Make reasonable balanced and well founded decisions ü Understand and apply Principles of Natural Justice Citizens Rights and the Principles of Good Administrative Practice ü Write unbiased logical objective reports on the circumstances of claimants ü Communicate the decision clearly in writing and quote legislative reasons ü Understand the claim review and

    fact that the local authorities have been operating the polluter pays principle in relation to commercial water rates for many years and full cost recovery for the supply of water to commercial users and if he will make a statement on the matter Thomas Pringle For PRIORITY answer on Wednesday 12th June 2013 Ref No 27066 13 REPLY Minister for the Environment Community and Local Government Mr P Hogan The Water Sector Reform Implementation Strategy which is published on my Department s website is focused on ensuring that appropriate policy and legal frameworks are put in place for Irish Water and the water sector A key objective is to rationalise the cost of the current service delivery and ensure more efficient operation of water services by moving from 34 water services authorities to a single body following enactment of comprehensive legislation later this year Irish Water will therefore become the water services authority from 1 January 2014 The Government has decided to assign responsibility for the economic regulation of the water sector including the setting of charges to the Commission for Energy Regulation It will be a matter for the Commission for Energy Regulation in due course to satisfy itself in relation to the appropriateness of costs incurred in the operation of Irish Water as part of the process of setting the tariffs for both the domestic and non domestic sector in the future It is envisaged that the Commission will engage in public consultation as part of this process A key role for the regulator will be to protect the interests of all customers and to drive efficiencies in the water services sector Be Sociable Share Previous Story Question on subsidiary protection procedures Next Story Oral Question on special instance houses for rural areas About admin Contact Info Killybegs

    on the matter Thomas Pringle REPLY The necessary legislative provisions to implement the new arrangements for the determination of existing and future applications for subsidiary protection are in preparation in conjunction with the Offices of the Attorney General Once these legislative provisions have been completed the new arrangements will be put into operation as soon as possible thereafter Further information is available on the Irish Naturalisation and Immigration Service INIS Website www inis gov ie and this information will be updated as developments occur The High Court in the MM case was arrived at following a referral to the European Court of Justice The legal advice to me was that this Judgment which relates to an applicant s right to be heard in the context of an application for subsidiary protection should be appealed to the Supreme Court and I have taken that advice on board In the mean time and pending the determination of this appeal the Irish Naturalisation and Immigration Service INIS in conjunction with the Offices of the Attorney General is working on the development of a framework legislative and administrative under which existing and future applications for subsidiary protection will be determined This framework will lay some of the foundations for what is proposed in the Immigration Residence and Protection Bill which I hope to re publish later this year under which it is envisaged that applications for asylum subsidiary protection and leave to remain will be dealt with as a single procedure As a result Deputies can be satisfied that there is no conflict between the appeal lodged and the plans to revise the existing subsidiary protection procedures The legislative provisions referred to above are being given priority attention Once the new arrangements are in place steps will be taken to have all outstanding applications

    on arrival in Ireland Under social welfare legislation decisions in relation to all aspects of claims are made by statutorily appointed Deciding Officers DOs and decisions in relation to Supplementary Welfare Allowance are made by Designated Persons DPs Each case received for a determination on the Habitual Residence Condition HRC is dealt with in its own right and a decision is based on the application of the legislation and guidelines to the particular individual circumstances of the case Before a decision can be made regarding a person s habitual residence it must first be established whether the person has a legal right to reside in the State For example nationals from outside the EU who have been granted special permission to remain in Ireland will need to provide an official letter from the Department of Justice and Equality to confirm their status and or a copy of their residency permit Garda National Immigration Bureau card The right to reside test is a question of law which seeks to ascertain whether the claimant has a lawful right to reside in Ireland Once the legal right to reside is satisfied the five criteria used to determine whether a person satisfies the HRC includes a the length and continuity of living in Ireland b length and reasons for any absence c nature and pattern of the person s employment d person s main centre of interest and e future intentions of the person applying for the social welfare scheme Examples of information required include identification documents such as a passport bank statements from outside and within Ireland as applicable utility bills such as electricity gas telephone rent mortgage agreements or receipts for local authority charges travel documents or evidence to move or store personal possessions The HRC is a question of fact which
