  • Press Release - Earlier Closing for Off-Licences
    within the last week Our members around the country are telling us that their customers do not realise that the new earlier closing time comes into effect before the end of July and members themselves are surprised that the new restrictions on opening hours are being introduced at such short notice said Mr McCabe When the new legislation was introduced the Minister for Justice Equality and Law Reform insisted that mixed retailers who sell alcohol should agree to abide by a code of practice in recognition of the recommendations of the Alcohol Advisory Group some of which are adopted in the new licensing laws The code of practice is to address issues such as the structural segregation of areas within supermarkets and mixed trade outlets where alcohol is merchandised and sold or arranging for alcohol to be sold from behind the counter It was expected that the new trading hours would have been brought into effect at the same time as the proposed code of practice and the fact that this is not happening has caused a substantial degree of confusion amongst the public and dissatisfaction amongst specialist off licences said Mr McCabe Under the new licensing laws off licence

    of legislation I would suggest that just as the Minister has discretion with Section 8 he has the same discretion with Section 4 I would again suggest that it is only equitable to all members of the drinks retailing industry that both sections are signed in at the same time or to have Section 4 signed in simultaneously with the introduction of the Code of Practice Our members feel greatly let down by the Minister who would appear to be caving to big business interests at the expense of the small independent specialist retailers The mixed trader is generally closed at ten o clock and is not affected by Section 4 and now will be allowed to continue to use alcohol to drive footfall into other areas of their stores Our members need to trade after ten o clock in order to survive economically and it was the changing buying patterns that segregation would bring that would have helped them compensate for these lost sales On a point of clarity regarding your last paragraph are you stating that mixed traders who hold an off licence will be obliged to close at ten o clock I would again ask you to

    without the presence of Section 8 you are further opening up the retailing of alcohol to untrained personnel in mixed trading environments who in many cases have no knowledge of the responsibility social or judicial obtaining to the sale of alcohol Till operators will be put under undue pressure from customers arriving at the counter with alcohol late in the evening unaware that it is not available for purchase because of the repeal of the licensing hours back to 10pm By closing earlier the specialist off licence sector was prepared to forgo up to 20 of its daily turnover in support of the legislation the purpose of which is to tackle alcohol abuse This was in recognition of the fact that mixed traders would also be impacted upon due to segregation Loss of sales will have serious economic implications for our members and they now perceive that the powerful mixed trading groups have somehow managed yet again to evade their responsibilities in regard to alcohol legislation As stated above we are prepared to do what is necessary however in the interests of equity and responsibility the repeal of off licence hours to 10pm closing should be introduced in conjunction with
