    the DES website as soon as it is known In the meantime the DES has for planning purposes identified 31 July 2015 as the date by which the advance actions set out in Department Circular 0026 2015 should be completed by registered teachers Until the Vetting Act is commenced Circular 0063 2010 will continue to apply 4 Circular 0026 2015 provides advice on the steps to be taken by 31 July 2015 by registered teachers who expect to be commencing a new employment in a new school from the beginning of or during the first term of the 2015 16 school year 5 The commencement of the Vetting Act is particularly relevant to teachers who expect to be undertaking new substitution work from the beginning of or during the first term of the 2015 16 school year Such teachers should take the steps outlined at Section 3 3 of circular 0026 2015 by 31 July 2015 so as to ensure that they are readily employable for new substitution work after the commencement of the Vetting Act The steps involve ensuring that the teacher notifies those schools in which he or she intends to work as a substitute of their availability for such work and providing a copy of his or her Teaching Council vetting disclosure letter to each of the schools concerned In some cases it may also involve applying to the Teaching Council by 31 July 2015 for a vetting disclosure from the Bureau which is the new type of vetting disclosure that will satisfy the requirements of section 12 1 of the Vetting Act Teachers should read section 3 to determine which if any actions they need to take Key points for school authorities 1 When section 12 1 of the Vetting Act is commenced a school will be required to obtain a vetting disclosure from the Bureau before commencing the initial employment of a new employee Failure by an employer to comply with this statutory requirement will be a criminal offence The immediate impact of the Vetting Act will be on the initial employment of new employees and will not in the short term affect existing employees or the re employment of employees currently working in the school It is important to note that until the Vetting Act is commenced Circular 0063 2010 continues to apply 2 The statutory vetting arrangements under the Vetting Act will in addition to the existing check for criminal offences also include a check for any relevant soft information This is an important new aspect of the vetting arrangements Soft information referred to as specified information in the Vetting Act is information other than criminal convictions held by the Garda Síochána that leads to a bona fide belief that a person poses a threat to children or vulnerable persons 3 Circular 0026 2015 outlines actions that should be taken by all school authorities in order to facilitate as far as possible a smooth transition to the statutory vetting requirements that will apply
