    of the holder of the licence Where the applicant for renewal is a limited liability company the application must be accompanied by a Certificate of Incorporation of the company issued by the Registrar of Companies not earlier than four weeks before the date of application for renewal Duplicate certificates can be downloaded from the website of the Companies Registration Office If you are carrying on business under a trade name that is not the same as the company or the individual holding the licence your application must be accompanied by a Certificate of Registration of Business Name under the Registration of Business Names Act 1963 Again duplicate certificates can be downloaded from the website of the Companies Registration Office The appropriate amount of Excise Duty Sale To Underage Drinkers Section 31 of the Intoxicating Liquor Act 1988 as amended makes it an offence for the holder of a licence to sell or permit sale to anyone under 18 years Prior to the Intoxicating Liquor Act 2000 it was a defence to a charge of selling to underage persons to show that in a particular case it was reasonable to think that a person was over 18 This defence no longer exists Furthermore the Intoxicating Liquor Act 2000 introduced the concept of temporary closure orders where licence holders are convicted of selling alcohol to underage persons The Intoxicating Liquor Act 2008 has also increased the fines for such offences with a potential fine of up to 3 000 for a first offence and up to 5 000 for a second or subsequent offence What Is A Temporary Closure Order If you are convicted of either selling or permitting sale to underage persons a Court must make a temporary closure order in addition to any fine or endorsement The order is made for the closure of the premises or a part of it for a period of a at least two days and up to seven days for a first offence and b between seven and thirty days for a second or subsequent offence What Is The Effect Of A Temporary Closure Order On Your premises Your premises is considered not to be licensed for the sale of intoxicating liquor during the period of closure A notice must be placed in a conspicuous place on the exterior of the premises stating the period of closure and also stating that the closure is in compliance with a Court Order You are required to honour your commitments to any employees working in the premises during the period The Act specifically states that no employee can be disadvantaged in his her employment by reason of the Order during the period of closure This means in practice that even though the premises will not be trading your employees must be paid It should be noted that employee means anyone working under a contract of employment or as a regular part time employee as defined by law How Can I Guard Against Committing This Type Of Offence

    allowed any occupier of such premises to apply to the Revenue Commissioners for a Wine Retailers Off Licence which specifically allowed for Off sales The 2008 Intoxicating Liquor Act changed this procedure and required a Wine Retailers Off Licence to be issued on foot of a District Court application It should be noted that once the Court grants the Order for the Wine Off Licence it is renewed annually by Customs and Excise The Revenue Commissioners have written to the wine retail on licence holders informing them that they must get a court order for a Wine Retailers Off Licence in order to sell wine for the licensing year September 30th 2011 to September 30th 2012 and each year thereafter This in effect means that Revenue may not renew Wine Retailers On Licences held by Supermarkets or Newsagents on September 30th next as they are not the appropriate type of Licence for those premises anyone who holds such a Licence should ensure that they make a Court Application for a Wine Off Licence in sufficient time for the new licensing year bearing in mind the fact that the Courts are closed for the month of August For further information contact

    an order under section 19 does not convert a hotel licence in to an ordinary publican s licence and the premises must still function as a hotel within the definition as outlined above with the requisite number of rooms Also a declaration from the court under section 20 2 of the Intoxicating Liquor Act 2000 would allow for the use of a public bar on the premises Sale of Intoxicating Liquor to the General Public There is no prohibition of sale of alcohol to the general public in a premises licensed under section 2 2 of the 1902 Act Liquor may be supplied to persons other than travellers or lodgers on the premises Can I upgrade a Hotel Licence to a full Publican s Licence The holder of certain licences granted for a hotel under Section 2 2 of the Licensing Ireland Act 1902 have the option to upgrade their Hotel Licence to a full Publican s Licence In order to qualify for the upgrade i The licence must predate 4th July 1960 ii The District Court must declare that it is satisfied that the premises has been operated at any time during the 5 years preceding the 6th July as if there was a publican s licence rather than an hotel licence attached thereto and iii The licensee must make a once off payment to the Revenue Commissioners What are the trading hours For further information on permitted trading times please see Restaurants and Hotels Permitted Trading Times with Meals Section 14 e of the Intoxicating Liquor Act 1927 as amended by section 10 of the Intoxicating Liquor Act 1943 provides for the sale of alcohol to lodgers outside of the normal permitted trading times Lodgers may be sold and supplied with liquor in any part of the licensed premises and at any time subject to a restriction on Good Friday that only permits intoxicating liquor to be sold and consumed with a meal Nothing in this Act shall be deemed to prohibit or restrict the sale of intoxicating liquor by the holder of an on licence at any hour on licensed premises to a person then lodging in such premises save that on Good Friday no intoxicating liquor may be sold to any such person except at and for consumption with a meal consumed by such person in such premises Renewal of a Hotel Licence Fáilte Ireland registration of a hotel is not a requirement for the initial grant of the licence but the Revenue Commissioners will require proof of such registration before issuing the renewal of a licence Inspection certification registration and grading of hotels is carried out by Tourist Accommodation Management Services Limited TAMS on behalf of Fáilte Ireland Licences must be renewed annually and in order to do so the licence holder must possess the following Fáilte Ireland Certificate Tax Clearance Certificate Short Certificate of Incorporation if Licensee is a company Certificate of Registration of Business Name A renewal notice will be sent to the
